After much anticipation, the new amendments to the Construction Act, together with its regulations (with minor exceptions), came into force on January 1, 2026.

The changes include expanded rights to adjudication, a new scheme for the mandatory annual release of holdback, and changes to the prompt payment regime broadening its applicability. Importantly, in its final form the changes no longer include the annual expiry of rights, so be sure to stay updated on the latest to know what to expect this year and beyond.
